1. Price of the trip
Depending on the nature of the services booked, it is possible that a certain number of the clauses mentioned below do not apply to the booking made.
All prices, supplements and discounts are per person, unless otherwise stated.
1.1 The price includes:
a) the transport of passengers and their hand luggage to and from the airport and 30 kg of hold luggage per person (1 piece of luggage per person, depending on the airline);
b) airport taxes in force on the date of the price calculation, unless otherwise stated;
c) the rental vehicle, pick-up and drop-off at the airport from Europcar-Guadeloupe.
d) the stay in a 1 bedroom bungalow at the Domaine Saint-François; e) VAT at the known rates.
1.2 Are not included in the price:
a) the costs of passport, visas, vaccinations and other formalities, unless otherwise stated; b) drinks, unless otherwise stated;
c) personal expenses and tips;
(d) excursions not expressly provided for;
(e) tourist taxes set by the local authorities and payable on the spot;
1.3 Discounts and promotions
Promotions are applied as indicated.
In the event of a change in your file, the reductions granted may be cancelled. You are also not entitled to new discounts. You will be notified at the time of the request for modification.
1.4 Additional fees
For exceptional file types, additional administrative fees are incorporated.
2. Price calculation
The price agreed in the contract is fixed and all the services provided and taxes are included, subject to obvious material error and the possibilities of price adjustment provided for in Article 5 of the General Conditions of Travel and provided for in Article 3 of the Special Conditions.
3. Composition of the price
3.1 Taxes and levies
Taxes and levies for the services delivered are also based on the rates valid on 10.02.2020. Increases or decreases in these levies and taxes after this date will be added or subtracted from the amount of the journey on a net basis.
4. Payment of the travel price
4.1 Advance payment
The deposit referred to in Article 6 of the General Conditions of Travel depends on the date of the reservation and the nature of the services. A (possible) change in the price of the trip cannot give rise to a revision of the deposit paid. 4.1.1 In the case of bookings made up to 42 days before departure:
30% of the travel price on receipt of confirmation. The balance is available from 42 days prior to departure and must be paid at the latest 30 days prior to departure.
4.1.2 In the case of late bookings (less than 42 days before the departure date)
In case of late booking (less than 42 days before the departure date) the total amount is due immediately.
4.2 Late payment or lack of payment
4.2.1 Reservations made 42 days or more prior to departure
In the event of non-payment or non-payment of an account on the due date, the following charges shall apply, ipso jure and without notice of default:
- conventional interest of 12% per annum on the amount still due from the due date;
- a fixed compensation of 10% of the amount still due, with a minimum of € 75;
If an account is not paid in full on the due date, Terres des îles, destination Guadeloupe, is entitled to cancel the trip after formal notice. In this case Terres des îles, destination Guadeloupe will charge the cancellation costs as provided for in Article 6, without prejudice to its right to claim additional interest and compensation. Any advance payments made by the traveller shall be charged against the costs of Terres des îles, destination Guadeloupe.
4.2.2 Reservations made less than 42 days before departure
In the event of immediate non-payment of the total amount of the trip, Terres des îles, destination Guadeloupe is entitled to cancel the trip by right and without formal notice. In this case, Terres des îles, destination Guadeloupe shall bear the costs of cancellation as provided for in Article 6, without prejudice to its right to claim additional interest and compensation. Any advance payments made by the traveller shall be charged against the costs of Terres des îles, destination Guadeloupe.
5. Condition for the reservation
A reservation can only be made by an adult person with legal capacity.
Cancellation of a booked trip can only be communicated in writing to the tour operator via e-mail to Terres des îles, destination Guadeloupe at the following address: email@example.com.
Cancellation fees vary depending on the date of cancellation. Cancellation fees are calculated according to the amount of the trip and the administration fee :
a) More than 56 days before the date of departure: 35% of the amount of the trip;
b) between 56 and 29 days inclusive before the date of departure: 50% of the price of the trip; c) between 28 and 22 days inclusive before the date of departure: 75% of the price of the trip; d) between 21 and 15 days inclusive before the date of departure: 90% of the price of the trip; e) from 14 days before the date of departure: 100% of the price of the trip.
In case of cancellation of an infant (non-paying baby less than 2 years old), the compensation due is €12.50. If the cancellation is made at the same time as that of an accompanying and paying traveller, then the supplement is not charged.
7. Modification of the contract of the package tour
a. By the tour operator
The tour operator reserves the right to make minor changes to the package tour contract. The tour operator shall inform the customer of such changes in a durable medium (e.g. by e-mail).
b. By the traveller
Changes to a booked trip are accepted subject to payment of a fee, in addition to any price adjustment.
Please be aware that previously granted discounts may no longer be valid, depending on the change requested. Current promotions are also subject to conditions, and may not be applicable in an amended file. You will be informed of this when you request a change.
Fees vary depending on the date of the change. (% of the trip amount = administration fee)
7.1 Correction of name; change of name; assignment
a) up to 29 days before the date of departure: the fees charged by the airline company (which can vary from administration fees to the total ticket price) plus 25 € per file;
b) from 28 days before the date of departure: the fees charged by the airline company plus € 50 per file.
7.2 Other changes
7.2.1 Change of hotel or apartment
a) up to 29 days before the departure date: 25 € per file;
b) from the 28th to the 8th day before the departure date: 25 € per file;
c) from the 7th day before the date of departure: 100% of the amount of the trip.
8. Responsibility Responsabilité
8.1 General information
Liability is governed by the Act of 21 November 2017 on the sale of package travel, related travel services and travel services. The tour operator shall not be liable (where applicable) in the event of force majeure, a situation which he could not foresee or resolve even by taking all reasonable measures, or in one of the situations listed in Article 50 of the Act of 21 November 2017. In the cases referred to in Article 51, §3 of the Law on the sale of package travel, related travel services and travel services of 21 November 2017, the liability of Terres des îles, destination Guadeloupe is limited to three times the total price of the trip.
8.2 'Community list' of air carriers
In accordance with Article 9 of European Regulation (EG) No 2111/2005 the tour operator is obliged to inform you of the existence of a 'Community list' of air carriers which are subject to an operating ban within the Community. This list can be consulted at http://air-ban.europa.eu.
8.3 Identity of operating air carriers
According to article 11 of the European regulation (EG) nr. 2111/2005 the tour operator is obliged to inform you about the identity of the carrier(s).
actual air traffic relating to your flight. If the identity of the operating air carrier(s) is not yet known at the time of booking, it will inform you of the name of the air carrier(s) that may actually operate the flight(s). You will find a list of the airlines concerned in the brochure.
The identity of the operating carrier of your flight will be communicated to you when you send your air tickets. In the event of a change in the operating carrier(s) afterwards, you will be informed as soon as possible and at the latest at check-in, or at the time of boarding if the connection is made without check-in.
8.4 List of operating airlines
Flights are generally operated by the airline Air Belgium, Air France, Corsair, Level, Air Caraibes.
8.5 Changes and errata
This offer was made with the data available at the time of writing. Any errata and/or changes will be transmitted as is as quickly as possible.
8.6 Start and end of services
The tour operator's services start at the airport of departure and end at the airport after the return flight.
9. Complaints Réclamations
9.1 Complaints at destination
All complaints should be reported as soon as possible, preferably in this order:
- to the service provider concerned
- by telephone (see info in travel documents)
If you do not file a complaint until you return from your trip, we may not always be able to ascertain the facts and you may also lose the right to compensation.
If the complaint mentioned on the spot could not be satisfactorily resolved or if it was not possible to formulate it at any time, the traveller must officially submit the complaint within one month of his return to the retailer or tour operator by registered mail or against acknowledgement of receipt.
9.2 Benefits not obtained
The equivalent value of the services not obtained will be reimbursed only on presentation of a certificate drawn up by the service provider, clearly specifying the services not provided to the client and liable to be reimbursed.
9.3 Supporting documents
When you make a complaint, you must submit all the relevant supporting documents. Only complaints submitted with supporting documents will be taken into consideration. In order to lodge a complaint about the execution of a flight, you may be required to present the ticket and the original boarding pass.
10. Travel documents
Only for files via the retailer:
- In case of confirmation more than 14 days before departure, the travel documents are sent to the retailer.
- In case of confirmation less than 14 days before departure, the link to the electronic documents is sent to the retailer.
All documents sent electronically are valid and can no longer be changed.
For a booking with a confirmation less than 7 days before departure, the travel documents are sent by courier at the expense of the holidaymaker.
11. Duty to inform oneself
Travellers are asked to read the information regarding the different aspects of their holiday. The different sections are listed on the website www.terresdesiles.com.
